Key v. Butch’s Rat Hole and Anchor Services, Inc. Case No. 2:17-cv-01171

A settlement has been proposed in a class and collective action lawsuit filed against Butch’s Rat Hole & Anchor Services, Inc. (“Defendant”), called Key v. Butch’s Rat Hole & Anchor Services, Inc.,  Case No. 2:17-cv-01171 (D. N.M.) (“Lawsuit”).  The Lawsuit alleges that Defendants improperly classified certain employees as exempt and excluded certain payments from the regular rate of pay which resulted in Defendant’s failure to pay overtime to these individuals.  These individuals are or were employed by Defendants in New Mexico as Casing Floor Hands (“ Settlement Class Members”), at any time during the period from November 28, 2014 to November 28, 2017, (“Settlement Class Period”).  Defendants deny the allegations in the Lawsuit and deny they violated the law.

When is the Final Approval Hearing?

 The Court will hold a hearing in this case on January 20, 2022, at 9:00 a.m. at U. S. Courthouse, 100 N. Church Street, 320 Tortugas Courtroom (North Tower), Las Cruces, New Mexico 88001., to consider, among other things, (1) whether to approve the Settlement as fair, adequate, and reasonable, (2) a request by the lawyers representing all Settlement Class Members to an award of no more than $158,000.00 in attorneys’ fees and no more than $15,000 in litigation expenses and reimbursable costs for litigating the case and negotiating a settlement, and (3) a request for $7,500.00 as a service award to Named Plaintiff Key for his service in initiating and pursuing the litigation.
